This was a fixed term tenancy that commenced on 10 October 2023 and was to terminate on 31 July 2024.

The premises were attached to a farm and were generally used as “service accommodation” for the farm employees. The farm owner had intended the tenancy would end on 31 July 2024 and their new employee and his family would take over the premises.

The fixed term was clearly set out in the Tenancy Agreement provided to the tenant. On 20 February 2024 the tenant sought a copy of the tenancy agreement, which was provided to him again, setting out the fixed term.

The landlord advised the tenant on 27 February 2024, 31 May 2024 and 10 June 2024 by email that he had to leave on 31 July 2024. The landlord, owner and tenant met on 10 June 2024 and talked about the end of the tenancy on 31 July 2024.

Despite knowing that this was a fixed term tenancy, and that the tenancy ends on 31 July 2024, the tenant has not left the property.

The farm owner has their employee, his wife and two children staying in temporary accommodation and waiting to move into their house, which was part of their employment contract.

The tenancy is to terminate at 11.59pm on Sunday 29 th September 2024 and possession is given back to the landlord after that time and date.

Despite asking the tenant if he wishes to pursue any further claims relating to the start of the tenancy, he did not express any other concerns other than not wanting to leave the property until he has alternative accommodation.

I am dismissing the tenant’s application.
