Reasons
- Both parties attended the video hearing. The landlord was represented by Ms Bianca du Toit.
- The landlord had originally applied for termination, rent arrears, refund of the bond and reimbursement of the filing fee.
- However, since the application was filed, the tenancy came to an agreed end on 3 October 2024. Following the end of the tenancy, the tenant agreed to the bond being released in partial payment of the rent arrears outstanding at the end of the tenancy.
- The landlord therefore amends the application to one for rent arrears only (for the amount outstanding in rent arrears after payment of the bond) and reimbursement of the filing fee.
How much is owed for rent?
- The tenancy ended by agreement on 3 October 2024. The landlord provided rent records which prove the amount owing at the end of the tenancy.
- The total rent arrears owed at the end of the tenancy was $2,761.29. The tenant agreed to the bond of $1,120.00 being refunded to the landlord in partial payment of those arrears.
- The bond was released to the landlord on 7 October 2024. After applying the bond to the rent arrears, the remaining rent arrears owed is $1,641.29.
- The tenant does not dispute the amount owed in rent arrears and I make an order accordingly. Reimbursement of the filing fee
- Given the landlord has succeeded with the claim the tenant must reimburse the filing fee.
