Reasons

Both parties attended the hearing. The tenants late request to attend by telephone was permitted.
The landlord has applied for costs that were incurred by her due to the tenants ending the fixed term of the tenancy early ($667), compensation for painting in relation to damage to a kitchen bench side, wardrobe and office wall ($195.50), the replacement of the side of a kitchen bench ($580.75), rubbish removal ($109.25) and electrical work ($149.50) following the end of the tenancy.
The tenant has applied for the return of their bond and for compensation for work they did at the premises including a unit they installed and light fittings (x2). There is also a compensation claim for breach of quiet enjoyment.
The Tribunal heard the landlord’s claims for the cost of ending the tenancy early, the board in the kitchen and the rubbish removal. The Tribunal partially heard the painting claim. There was then a suitable break in the proceedings and the tenant agreed to pay $922.25 of the bond to the landlord in settlement of all of her claims and agreed that they would not pursue their own claims. This was agreed to by the landlord.
An order has been made to reflect this agreement.
The parties seek suppression of their identifying details and I have awarded this. It is in the public interest that parties can resolve their disputes, and this same result could have been achieved at mediation. However, it was expedient for the Tribunal to assist the parties at the hearing itself.
