Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant’s name and identifying details.
- [The tenant/s] owes Mcdonald Property Management Limited Acting As Agent For Ju Chen & Lihua Zhang Family Trust $2,544.25 (“the debt”) being: a. water arrears of $2,517.25 up to and including the Watercare invoice dated 26 November 2024; and b. the filing fee for this application of $27.00.
- [The tenant/s] must pay rent and the debt as follows: a. By 10 fortnightly payments of $240.00 and a final payment of $144.25; b. Payments will be every other Wednesday, with the first payment on 11/12/2024 and continuing until the final payment on 30/04/2025.
- Payments will be allocated in the following order: rent (if the rent is in arrears), water arrears, and the filing fee.
- If the tenant fails to pay the water arrears within 2 working days of the due dates the balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing which was held by phone. Mark Gruebner appeared on behalf of the landlord.
- This is a very longstanding tenancy which began in 2010.
- The landlord seeks an order for water arrears and the filing fee for filing this application. The landlord provided water invoices and a statement of tenancy outgoings.
- The tenant acknowledged that the water arrears were owing as claimed by the landlord. The tenant said that she had gotten behind in making water payments would like to pay off the water arrears as soon as possible.
- The parties agreed that the tenant would pay the water arrears and the filing fee for this application at a rate of $120.00 per week, payable fortnightly.
- I have made orders by consent on this basis. The tenant understands that if any of the payments are missed by two days the total amount of water arrears and the filing fee will become payable immediately.
- As discussed at the hearing, if the tenant anticipates having any issues with making the payments as agreed and ordered, she should contact her landlord as soon as possible.
- The tenant sought an order for name suppression. As these orders have been made by consent I do not consider that there is any public interest in publication of the tenant’s name. I have therefore exercised my discretion to make an order suppressing the tenant’s name and the tenancy address.
