A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 22 August 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. On this date the landlord conducted an inspection which showed that the tenant had moved out. Photographs were provided of the premises empty of personal belongings and household appliances. There was some furniture in the garage and a lounge suite inside.

The landlord states that they have tried to contact the tenant by email and text but had no reply.

The landlord provided rent records which prove the amount owing at today’s date.

Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately.

All the requirements for an expedited abandonment application have been met.

Section 95A RTA states regarding suppression orders that the Tribunal must, on the application of a party that has wholly or substantially succeeded in proceedings, order that the party’s name or identifying particulars not be published, unless the Tribunal considers that publication is in the public interest or is justified because of the party’s conduct or any other circumstances of the case.

The landlord is wholly successful and name suppression is granted.
