Reasons

Both parties attended the hearing.
The tenancy ended in June 2024 after the landlord gave a 63 day notice because they were moving into the tenancy premises to live. The tenants have filed an application because the house went on the market and was sold in September 2024. They submitted they should have been given 90 days notice instead.
The owners served a 63 day notice on 8 April 2024 and the last day of the tenancy was to be 11 June 2024. The reason given on the notice was that the owners required the premises within 90 days after the termination date as the principal place of residence (for at least 90 days). Notice for this reason was allowed at the time pursuant to section 51(1)(a) of the Residential Tenancies Act 1986 (RTA).
The owners said the tenants moved out on 9 June. The owners moved into the tenancy premises that same day. They put the house on the market. They lived in the house until it sold, which was 99 days after the termination date given on the notice. I have been provided with various documents to prove the owners lived in the premises and the agreement for sale and purchase showing settlement was on 18 September 2024.
I am not persuaded the owners did anything wrong when they put the house on the market for sale during their 90 days of living in the premises. The RTA sets out that if the owners choose to give notice under section 51(2) they must live in the house for at least 90 days. I find there was no breach by the owner. This claim is dismissed.
I am using my discretion to allow suppression for both parties. The tenants have asked for suppression for health reasons. Given there has been no breach of the RTA I find suppression should be allowed. See section 95A RTA.
