Order
- The tenant owes the landlord $9,303.00 for rent arrears to 25 September 2024 (“the debt”).
- The tenant must pay rent and the debt as follows: a. Rent for the fortnight to 24 September 2024 is to be paid immediately if rent has not been paid since 12 September 2024. b. The arrears are to be paid by 232 fortnightly payments of $1,012.00, being $972.00 for normal rent and $40.00 for the debt. c. A final payment of $995.00, being $972.00 for rent and $23.00 for the debt. d. Payments will be every other Wednesday, with the first payment of the additional $40.00 on 25/09/2024 and continuing until 17/08/2033.
- Payments will be allocated in the following order: rent then rent arrears.
- If the tenant fails to pay rent and rent arrears within 2 working days of the due dates: a. The tenancy at [Tenancy address suppressed] will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing.
- The landlord applied for termination of the tenancy and rent arrears. The tenant agreed to the landlord’s offer to continue the tenancy provided she paid an extra $40.00 per fortnight. The tenant agreed to termination if she failed to pay rent and arrears as set out above. Suppression
