The Tribunal may reduce a fixed term tenancy where: a. there has been an unforeseen change in the applicant’s circumstances; and b. there would be severe hardship to the applicant if the term is not reduced; and c. the applicant’s hardship would be greater than the hardship to the other party if the term is reduced. See section 66(1) Residential Tenancies Act 1986.

There has been an unforeseen change in the tenant's circumstances. The tenant is required to provide full-time care of her grandfather who is suffering from a serious illness and is unable to care for himself. The tenant’s family are unable to assist with providing full time care for the grandfather as her parent live overseas and her cousin has just become a new parent.

The tenant would suffer severe hardship if the term of the tenancy were not reduced. The tenant has been travelling between Auckland and the Waikato area to care for her grandfather. She cannot continue to fund the travel costs and pay rent for a unit in Auckland that she cannot live in full time.

The landlord has stated that they would suffer hardship if the term were reduced as there are few tenants seeking units of this type at present. The landlord is totally opposed to reducing the term of the tenancy.

I find that the tenant’s hardship would be greater than the landlord’s hardship.

Where the Tribunal reduces a fixed-term tenancy, it may order the tenant to pay the landlord reasonable compensation for any resulting loss. See section 66(2) Residential Tenancies Act 1986.

The tenancy will terminate in 4 weeks’ time. The tenant will have to pay the landlord a further 4 weeks rent to 30 October 2024, despite that she will not be living there full time.

The fixed term tenancy is reduced and will terminate at 11.59pm on Wednesday 30 th October 2024.
