The landlord invites the Tribunal to terminate the tenancy for a breach of s.55(1)(c) of the Residential Tenancies Act 1986 (“RTA”).

Section 55(1)(c) RTA provides the Tribunal shall make an order terminating the tenancy, if the Tribunal is satisfied that the tenant has assaulted or threatened to assault the landlord or agent of the landlord.

An assault is the intentional application of force to another. A threat of assault is an expression of intent to do harm to another person by the use of force.

The undisputed evidence of the landlord’s staff member was that he attended at the tenant premises on 28 August 2024 to carry out a routine inspection. Notice of the intention to carry out the inspection had been given to the tenant. For reasons that are not readily apparent, the tenant became angry and said that he would “knock you the fuck out.” The tenant told the staff member to leave. The staff member replied that he couldn’t as the tenant was blocking his exit. The tenant then grabbed the staff members hoodie with both hands in the chest area and over his shoulder. The tenant continued to swear at the staff member.

A number of s.55(1)(aa) RTA breach notices have been served on the tenant for violent or offensive behaviour towards staff and neighbours. Those notices were not all served within a 90 day period as required by the RTA. They do however give some background to the tenancy.

The tenant accepted the landlord’s evidence and explained that he did have anger issues and that he had a difficult past. He said that there was no excuse for his behaviour.

The RTA says that where a landlord has proven that an assault or threat of assault has occurred, the Tribunal shall terminate the tenancy.

I accept the landlord’s evidence. An assault and threat of assault have occurred. The tenancy is terminated.

Both parties applied for name suppression. The landlord has been wholly successful and suppression of the landlord name and details is ordered. The tenant has not been wholly or substantially successful and the tenant application for suppression is dismissed.
