Reasons
- The landlord attended the video hearing. The tenant made no appearance. A call to the tenant’s last known number did not connect.
- The landlord has applied for compensation for cleaning following the end of the tenancy.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986. The tenant is required to replace worn out smoke alarm batteries during the tenancy. See section 40(1)(ca) Residential Tenancies Act 1986. The tenant must also replace standard light bulbs.
- The tenant did not leave the premises reasonably clean and tidy.
- In support of the claim, the landlord filed a copy of an inspection report dated 31 January 2023 (Entry Inspection Report), completed a day before the tenancy commenced, and a copy of an inspection report dated 1 August 2024 (Exit Inspection Report), completed a day after the tenancy ended.
- The Exit Inspection Report shows the property was not left reasonably clean and tidy. The photos show debris on the floors throughout the premises, marks on walls including pen marks and dirt and grime in the kitchen, bathroom and laundry.
- Kainga Ora have provided a work order for the premises which records the established cost for cleaning the entire property was $739.68. The tenant has a rent credit of $166.00. After the rent credit is applied to the cleaning cost, the outstanding amount is $573.68.
- The amounts ordered are proved.
