Where rent was at least 21 days in arrears on the date the application was filed the tenancy must be terminated. See section 55(1)(a) Residential Tenancies Act 1986.

However, the Tribunal may refuse to terminate a tenancy if, but only if, it is satisfied that the breach has been remedied, the landlord has been compensated for any loss arising from the breach, and it is unlikely that the tenant will commit any further breach in respect of rent arrears. See section 55 (2) of the RTA.

The landlord advised that the tenant has now paid the rent arrears, is currently in credit and termination was not sought. The landlord sought a conditional termination order however I do not consider there is jurisdiction for the Tribunal to make a conditional termination order in respect of rent to be paid in advance. See section 55 (1A) and (1B) of the RTA.

The tenant explained that he had a relationship end which has left him with a number of bills to pay alone but he has paid employment and is working constructively to ensure he pays his rent. He confirmed to the landlord he will pay the amount owing to ensure he is one week in advance on 29 November 2024. I consider it unlikely the tenant will commit any further breach in respect of rent arrears.

The application for termination is accordingly dismissed. Filing fee

As the landlord has not been wholly or partly successful in the claim, I have not reimbursed the filing fee. See section 102 (4) of the RTA. Suppression

Both parties sought name suppression and having regards to the interests of the parties and that I consider there is no public interest in publishing the parties names I make an order suppressing both parties name and identifying details. See section 95 A of the RTA.
