Order
- The tenancy of Ayla Dane Heta at 6 Matthews Road, Wainuiomata, Lower Hutt 5014 is terminated, and possession is granted to [The landlord/s], at 11.59pm, Thursday 14 November 2024.
- Ayla Dane Heta must pay [The landlord/s] $1,644.86 immediately, calculated as shown in the table below:
Reasons
- The landlord attended the hearing by video. The tenant did not attend the hearing. An attempt was made to join the tenant to the hearing by telephone but the call went to voicemail.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy.
- After the hearing the landlord advised that the bond had not been lodged with the Bond Centre. The reason provided for not lodging the bond is not accepted as a valid reason, but that issue is not before the Tribunal. The landlord is reminded that it must comply with section 19(1)(b) Residential Tenancies Act 1986. The bond money is deducted from the amount owed by the tenant.
