The landlord has applied for termination of the tenancy for breach of the tenant’s obligations.

Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

Section 40(2)(c) provides as follows. The tenant shall not— cause or permit any interference with the reasonable peace, comfort, or privacy of any of the landlord’s other tenants in the use of the premises occupied by those other tenants, or with the reasonable peace, comfort, or privacy of any other person residing in the neighbourhood. (my bold)

Section 41(1) provides:

Tenant’s responsibility for actions of others The tenant shall be responsible for anything done or omitted to be done by any person (other than the landlord or any person acting on the landlord’s behalf or with the landlord’s authority) who is in the premises with the tenant’s permission if the act or omission would have constituted a breach of the tenancy agreement had it been the act or omission of the tenant.

The tenant (and/or her partner who is at the premises with her permission) has breached their obligations by interfering with the reasonable peace and comfort of persons in the neighbourhood.

The landlord repeatedly served a 14-day notices on the tenant. The tenant has not remedied the breaches within the required period. The disruptive behaviour at the property continues to be a problem for neighbours. The NZ Police have been at the property on numerous occasions since the 14 day notices were issued.

It would be inequitable to refuse to terminate the tenancy because of the ongoing breaches. The tenant has also stopped paying rent. The tenancy could have ben terminated due to rent arrears over 21 days. Filing Fee

Because the landlord has been wholly successful with the claim, the filing fee of $27.00 is ordered.
