- The residue of the bond is to remain at the Bond Centre in the tenant name [Tenant 2].
Reasons
- All parties attended the hearing.
- [Tenant 3] commenced this fixed term tenancy in February 2024 with [Tenant 2] and [Tenant 1]. Her involvement in the tenancy was assigned to another on 1 June 2024. [Tenant 3] now seeks her share of the bond be refunded to her. The landlord filed a cross application to her claims.
- The parties have discussed the claims and agree as follows: a. [Tenant 3]’s share of the bond is $2,500. b. From her share, $109.25 is to be paid to the landlord in compensation for required painting. c. The residue of $2,390.75 can be released to her as her tenancy has ended.
- [Tenant 1]’s tenancy has also ended. Her bond share was $625. From her share it is agreed that $109.25 is to be paid to the landlord also for painting works. The remainder of $515.75 is to be refunded to [Tenant 1].
- Any residue of the bond is to remain at the Bond Centre in the tenant name of [Tenant 2] as he continues in the tenancy.
- This order constitutes full and final settlement regarding the tenancies of [Tenant 3] and [Tenant 1] at [Tenancy address suppressed]. [Tenant 2]’s tenancy continues.
- As this order is made by consent it is appropriate that all party identifying details be suppressed from the published order.
