The Tenant shall pay the debt by weekly payments of $840, comprised of: a. $740 for normal weekly rent; and b. $100 for rent arrears.

The above payments are to commence on 19 November 2024 and continue until the debt is paid in full.

The payments are to be apportioned to rent, rent arrears and the filing fee.

If the Tenant fails to make the ordered payments within two working days of the due date, the entire outstanding debt becomes payable immediately.

This order will cease to have effect once all rent arrears and the filing fee are paid to the Landlord.

Reasons

The Landlord attended the hearing. The Tenant did not. I called the Tenant during the hearing. She did not answer. I have also confirmed that a Notice of Hearing was sent to the Tenant, so I proceeded without her.

The Landlord has established that the Tenant is in arrears. The rent summary provided by the Landlord shows arrears of $1,420.

The Landlord initially applied for termination of the tenancy and rent arrears. During the hearing, the Landlord advised that it no longer sought termination, and instead wanted to recover rent arrears by way of a conditional order. The Landlord also advised that he had discussed repayment arrangements with the Tenant, and she had agreed to make payments of $100 per week towards the rent arrears. She has not yet started to make those payments, so the Landlord seeks an order requiring the repayment to be made.

I agree that an order on those terms is a sensible way to resolve this claim and order accordingly.

I note that the Tenancy Agreement records that the rent is $770 per week. The rent summary provided by the Landlord shows that the rent payable is $740 – less than initially agreed. In making my orders, I have relied on the information set out in the rent summary – which I accept as an accurate record of the rent payments made by the Tenant. I therefore proceed on the basis that the rent arrears are $1,420, as set out in the rent summary.

The Landlord has applied for name suppression and has been wholly successful in the application. Suppression of the Landlord’s name is therefore granted.

The Landlord is also entitled to recover the filing fee of $27.
