Reginald S Newport must pay weekly rent and the debt as follows: a. By 293 weekly payments of weekly rent (set in accordance with his income-related rent) plus $35.00 for the debt. b. Payments will be allocated in the following order: rent, and the debt.

If the tenant fails to pay rent or the debt payment within 2 working days of the due dates: a. The tenancy at 71 Peace Street, Whakatane, Whakatane 3120 will terminate and the landlord will have immediate possession of the premises. b. The balance of the debt will be payable immediately.

Where rent is at least 21 days in arrears on the date the landlord filed its application, the Tribunal must terminate the tenancy under s 55(1)(a) and (1A) Residential Tenancies Act 1986 subject to limited exceptions that do not apply here.

However, today the landlord seeks only conditional termination. It does not require the Tribunal to apply the full rigour of s 55(1)(a). The Tribunal may grant that order because it has a general discretion to make conditional orders independent of s 55 under s 78(3).
