Where the tenant finds alternative accommodation earlier than 15 April 2025, the tenant may end the tenancy by the giving of no less than 14 days written notice to the landlord.

The tenant must remove cameras from the premise, and contain the dog for viewings, which the parties have agreed with take place no more than twice a week, with each viewing being for a maximum of one hour. The landlord must give the tenant 48 hours’ written notice of viewings and hold one on a weekend day and one on a week day.

A further 420 minutes (a full 7-hour day) should be allowed for the next hearing of this matter, scheduled before me at NorthShore District Court on the next available date as insufficient time was scheduled for the number of claims and the complexity of the claims.

If either party intends to produce any additional photographs, documents or videos at the next hearing, they must bring two copies of the documents and/or photographs to the Tribunal, one for the adjudicator and one for the other party and a device to play the video on. The photographs, documents and videos must be filed in the Tribunal at least 48 hours before the next hearing, by emailing them to aucklandmetrotenancy@justice.govt.nz and quoting application number 505886 in the subject line. Any documents filed must also be emailed to the other party.

Reasons

Both parties attended the hearing on 18 February 2025.

The amount of time scheduled for this hearing was not enough to address all the tenant’s substantive claims.

We have still to hear the tenant’s claims for compensation, general damages and exemplary damages for failure to maintain, unlawful entry, failure to provide the premise in a reasonable state of cleanliness, breach of the smoke alarm regulations, breach of the heathy homes’ standards and breach of quiet enjoyment of the premise. The tenant has also applied for reimbursement of the filing fee.

The tenant’s reduction of fixed term tenancy claim was heard, and an agreement reached to reduce the fixed term tenancy to 15 April 2025, or earlier by the tenant giving no less than 14 days written notice.

The parties also agreed to following terms in relation to viewings for prospective tenants: a. The landlord will hold no more than two one-hour viewings per week for prospective tenants. One to be on a weekend day and one during the week; b. The landlord will give the tenant no less than 48 hours written notice of these viewings; c. The tenant will remove the surveillance cameras and contain the dog for viewings.

The parties also agreed that there will be no break lease fees passed on to the tenant for breaking the fixed term tenancy early and no further rent charged after the tenant has vacated the premise on 15 April 2025, or earlier by the issuing of 14 days written notice, if the landlord has been unable to re-tenant the premise by the tenant’s moveout date.

The parties will be notified in writing by Tenancy Services of the date and time of the next hearing on the next available date at NorthShore District Court before me.

A mandarin interpreter has been requested to assist the property owners to put their defence to the tenant’s claims to the Tribunal, and will be provided. Name suppression
