Both parties attended the hearing by telephone.
There is a sealed mediated order dated 26 April 2024, which states: The parties participated in mediation and agreed to the following orders: 1) As at the date of application, rent was at least 21 days in rent arrears. 2) As at Monday, 29 April 2024, the total debt is $3980.88, being $3960.44 for rent arrears and $20.44 for the application fee. 3) [The tenant/s] agrees to make payments to Colliers New Zealand Limited to pay off the rent arrears and application fee as follows: Weekly payments of $310.00, being $205.00 for current rent and an extra $105.00 for rent arrears and the application fee. These payments will begin on Tuesday, 30 April 2024 and will continue to be paid weekly each Tuesday until the rent arrears and application fee are paid in full. 4) All money paid will go first to current rent, then to rent arrears, then to the application fee. 5) If any payment of current rent or rent arrears is not made within two working days of the due date as indicated in 3) above, a) the tenancy shall end in fourteen days; b) vacant possession shall be granted to Colliers New Zealand Limited and Land Information New Zealand; c) the remaining rent arrears and application fee shall be due and payable in full immediately; and d) the parties confirm that it would be fair and reasonable to end the tenancy in these circumstances. 6) Order 5) above applies until the rent arrears are fully repaid. 7) If any payment of the application fee specified in 2) above is not made within two working days of the due date as indicated in 3) above, then the remaining application fee will be due and payable in full immediately. 8) Order 7) above applies until the application fee is fully paid.
