The tenant vacated the premises on 12 December 2024. One of the ways in which a tenancy can end is where a tenant surrenders the tenancy with the landlord’s written consent (s 50(1)(d) RTA). The situation in this case does not quite meet those requirements, although the landlord had previously given the tenant notice to vacate (which the tenant initially challenged). Even if the strict formalities have not been met, it is reasonable to infer that the tenant vacated in response to the landlord’s wish to end the tenancy.

In case there is any doubt whether the tenancy ended by surrender, there are grounds to terminate on the basis that rent was at least 21 days in arrears on the date the application was filed (s 55(1)(a) RTA).

For the avoidance of doubt, I have made a formal order that the tenancy has ended.
