An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details and the tenancy address.

The tenancy of Trinh Thi HA and Nguyen Van Hao at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], immediately.

The landlord has applied for termination of the tenancy for abandonment through the expedited process under section 91AA Residential Tenancies Act 1986.

Are there grounds for an expedited application?

I am satisfied that the two requirements for the expedited process are met: a. The tenant does not want to contest the abandonment application. b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 24 October 2024 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord said they received a police report on 24 October 2024 about the tenants growing marijuana at the property. All rooms at the property apparently had marijuana plants. The landlord said they tried to reach the tenant by texts and calling with no response. The landlord sent a 48-hour notice of their intention to visit the property and attended the property on 26 October 2024. They said they found extensive damage at the property, the switch box locked and the power disconnected at the property. They provided confirmation that power to the property had been disconnected, copies of texts to the tenants, and a number of photographs. The photographs show ripped window covers and curtains, lines strung up across ceilings and walls, extensive growing parphenalia, such as large pots with soil, multiple small stools, tubing, large canisters, jugs, plastic sheeting on the floors. There were photographs of empty cupboards and empty cabinets in all the rooms and rubbish strewn throughout the property. Whilst the photographs showed couches, a TV and some pots and pans in the kitchen, there were no other signs of personal belongings or food or beds or bedding in the photographs provided. I am persuaded by this evidence that the tenancy has been abandoned.

The tenants have not contested the application.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately. Suppression

The landlord requested name suppression and are entitled to this as they have been successful with the claim. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published.
