If the requirements for the expedited process are met, the Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986. A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

I am not satisfied that both conditions for the expedited process are met. The landlord provided a copy of the Tenancy Agreement indicating the start date of the tenant was to be 25 October 2024, fixed term to 26 October 2025. The landlord provided a copy of an email they sent to the tenant on 30 October 2024 asking for payment of the bond and rent. The rent summary provided showed no rent has been paid by the tenant. The landlord said the tenant has not moved into the property yet. There were no inspection reports, photographs of the property or any further information as to why the tenant has not yet moved into the property.

The information provided by the landlord with this application is insufficient to enable the Tribunal to determine it properly without a hearing.

I have allowed name suppression because the matter has not been finalised.
