The landlord applied for termination of the tenancy, but it was evident from the documents filed that the tenancy has been terminated, but the tenant will not leave. The landlord wants an order to assist in having her removed. Accordingly, I treated the application as one for possession of the premises following the termination of the tenancy.

There is no dispute that on 18 October 2024 the landlord gave the tenant notice to vacate by 20 November 2024. The tenant says that there should have been a public meeting about this and that she is being discriminated against.

This is a boarding house tenancy. Section 66U of the Residential Tenancies Act 1986 sets out the ways in which a landlord may terminate such a tenancy. Under section 66U(1)(d), the landlord may terminate on 28 days’ notice with no reason. The notice dated 18 October 2024 complies with this.

In fact, the landlord has an important reason to terminate the tenancy. The landlord is a sub-tenant and the owner has given notice to terminate the lease and they require possession 16 January 2025 and would prefer possession in December. The landlord has terminated the tenancies of 28 other tenants. Only this tenant and another remain. Even if that were not the case, the landlord is entitled to possession.

The tenancy ended on 20 November 2024, which is less than 90 days ago. The requirements of section 64(1) of the Residential Tenancies Act 1986 are satisfied. Possession is granted to Everdell Holdings 2022 immediately.
