- The Tenant did not vacate the premises on the vacate date. The Landlord had to apply to the Ministry of Justice Collections Unit to have a bailiff enforce the termination order and procure possession of the premises.
- The date of possession by the Landlord via the bailiff was 25 November 2024. No rent payments have been received from the Tenant since the termination date, though the Tenant did not quite the premises.
- The rent from 6 November 2024 to the 25 November 2024 is $814.00.

- On the basis of the Landlord’s photos and oral evidence, I award the following: a. $130.00 – tip fees – general rubbish b. $958.00 – 2x skip bins – rubbish and Tenant’s property
- Because Trucking Homes Limited has wholly succeeded with the claim I must reimburse the filing fee of $27.00.
