On the 13 May 2025 I made an order awarding rent and water to the landlord and adjourning the landlord’s claim for $86,389.for compensation for damage to the property.

This decision should be read in conjunction with my order of that date.

I adjourned the landlord’s claim for damage to the property on the basis that the landlord had further documents that it wanted to submit in support of its claim.

The landlord has not filed any further documents in the intervening 5 months, despite being reminded to do so on at least two occasions.

I am therefore determining the claim on the evidence that has been provided both at the hearing on the 13 May and the evidence on file.

I am not satisfied that the landlord has proven that the tenant has damaged the property, I say this for the following reasons: a. The ‘before’ photographs were undated, and therefore I cannot confirm whether they accurately represent the condition of the property at the beginning of this tenancy. b. The inspection report given to me at the last hearing is undated and whilst the landlord told me that it was completed at the end of the tenancy, it looks like someone is living in the property because there is food on the bench stacked tidily with appliances and all the rooms have beds and what looks to be tenant’s belongings. c. The photographs show an extensive problem with mould at the property it is on almost every ceiling and wall. The Tribunal is often asked to adjudicate on mould claims and is given photographs of mould problems. Mould of this nature and extent is usually an indication of an underlying problem with the building, such as a leak in the roof or plumbing. I do not consider it likely that the tenant caused this mould. I also note that in the inspection photographs that were provided that the windows are open. d. The landlord’s termination notice said that the landlord wanted to undertake a full renovation. The undated quotes from the builder, show work that is for renovation not remediation. e. The landlord only supplied quotes for work. There is no evidence that the work was done. f. The landlord told me that they receive insurance cover for some of the work but has not filed any evidence to show me what the landlord told the insurance company about how the damage was caused and when.
