Reasons

Both parties attended the teleconference hearing on 31 st January 2025.

The landlord claimed that the tenant did not maintain the premises in a reasonably clean and tidy manner. The landlord wanted the problem fixed.

Under section 40(1)(a)-(e), Residential Tenancies Act 1986 (“RTA”), a tenant has specific obligations in relation to the tenancy premises.

Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. See section 78(1)(e) RTA.

A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. See sections 78(2AAB) and 78(2AAC)(a) RTA.

The tenant did not dispute that the premises was not kept reasonably clean and tidy. The tenant explained that there were personal and family issues that stopped her from keeping the premises reasonably clean and tidy.

The tenant also did not dispute that she refused the landlord from having access when they were entitled to enter. This was also linked with the tenant’s personal issues and the fact that the premises was not clean and tidy enough for the inspection.

The tenant explained that she did try but was unable to complete the rubbish removal due to issues outside of her control at the time.

The tenant agreed to pay the landlord $390.43 for a 3 cubic metre skip bin if the landlord could provide it so the tenant can remove the rubbish with members of her family.

The tenant agreed to mow the lawn by 10 th February 2025.

The tenant also understood that she must allow the landlord to enter the premises when they are entitled to enter. If the tenant refuses the landlord entry without reasonable excuse, exemplary damages can be awarded against the tenant up to a maximum of $1,500.00. Therefore, it is very important that she does not refuse the landlord’s rightful entry.

As the tenant did not dispute the monetary order, work order or the declaration, I make the orders as stated above accordingly.
