- This application is struck out because the issue of the bond has already been heard and determined.
Reasons
- Both parties attended the hearing which was held by video conference.
- Ms Witteveen has made an application for a return of the bond of $2240.00.
- At today’s hearing the landlord advised that the Tenancy Tribunal had already heard an application regarding this bond and on 16 December 2024 split the bond between the landlord and another tenant. See application number 5087589.
- Ms Witteveen was not named as a respondent in that application, although it was acknowledged at today’s hearing that the bond form had been signed by both tenants.
- Given that the bond issue has already been heard and determined, I have struck out Ms Witteveen’s application.
- At today’s hearing I advised the parties that one possible way forward is for Ms Witteveen to apply for a rehearing out of time of application number 5087589, even though she was not named as a party to that application.
- I was careful not to say that she would be successful in that application. That is for the adjudicator hearing that application to decide.
