Should the tenancy be terminated?

The Tribunal may terminate a tenancy for breach where, due to the nature or extent of the breach, it would be inequitable to refuse to terminate. See section 56(1) Residential Tenancies Act 1986.

Where the breach is capable of remedy the landlord must first serve a notice on the tenant requiring them to remedy the breach within at least 14 days and establish that the tenant has failed to do so.

The tenant has breached their obligations by having a dog at the property which is a breach of a “no pets” clause in the tenancy agreement.

While the Tribunal will not “rubber stamp” such an application, there are circumstances such as this where the termination is reasonable.

In this case the evidence shows that the dog is causing damage to the window frames (scratching) carpet (staining and damage) and exterior lawns and gardens (digging and defecating with the excrement left in multiple places on the lawn and in the gardens.

The photographs confirm the landlord’s evidence that the dog is also a breed that might reasonably be considered dangerous. The property manager said she was concerned for her safety when she attended to do the inspection.

It is also relevant that the tenant did not attend the hearing and did not attend mediation either, to provide any reason that the termination might be a disproportionate or unfair consequence of the breach.

The landlord served a 14-day notice on the tenant on 2/12/2024, and the tenant did not remedy the breach within the required period. Photographs taken on 16 December 2024 and then on 13 February 2025 confirm that the dog remains at the property. This despite the tenant contacting the property manager when the 14 day notice was issued and stating that she would rehome the dog.

The landlord said that as all rent and water rates are paid, the tenant could be permitted two weeks to vacate. The tenant is therefore terminated on Sunday 9 March 2025 to allow a reasonable time for this to occur. If the tenant is able to or wants to leave earlier, she can do so with 48 hours’ notice to the landlord.

The landlord’s request for name suppression is approved.
