Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
- Vladyslav Zapisochnyi owes [The landlord/s] $3,588.00 being $2,989.00 for rent owing to 4 January 2025 and power costs of $599.00 (“the debt”).
- Vladyslav Zapisochnyi must pay the debt as follows: a. By one payment of $150.00 on or before Friday 7 February 2025; and b. By weekly payments of $50.00 commencing on Friday 14 February 2025 and continuing every Friday until the debt has been paid in full.
- If the tenant fails to pay the debt as set out above within 2 working days of the due date(s), the balance of the debt will be payable immediately.
Reasons
- Both parties attended the hearing and consented to the terms of order 2 to 4 above.
- The landlord has applied, in it’s application, for a suppression order. Section 95A of the Residential Tenancies Act 1986 provides that the Tribunal must, on the application of a party who has been wholly or substantially successful in the proceedings, order that the party’s name or identifying particulars not be published (unless the limited circumstances set out in the section apply).
- The landlord has been wholly successful in their claims and the limited exceptions set out in s 95A do not apply. I therefore make an order that the landlord’s name and identifying details be suppressed.
