Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the landlord’s name and identifying details.
The landlord may dispose of the goods left at the premises by the tenant as the landlord sees fit.

Reasons

Both parties attended the hearing.
The landlord has applied for the disposal of goods the tenant left at the boarding house premises at the end of the tenancy. The primarily include clothing and bags.
The landlord has been unable to contact the tenant to arrange for collection of goods left at the property. The tenant advised at the hearing that he has no objection to the goods being disposed of and/or that the goods are not his.
It is not practicable or necessary for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
The landlord has sought name suppression and as they have been successful, I have granted this. The tenant also sought name suppression; however, no relevant grounds were advanced and this request is declined. R Harvey-Lane 10 February 2025
