- The application is dismissed.
Reasons
- A hearing was held in relation to this application on 1 May 2025. That hearing was adjourned to allow another tenant to be added to the claim.
- On 9 May 2025 the applicants were sent a notice of hearing advising them that a video conference hearing was scheduled for today, 26 June 2025, at 9.30am.
- The applicant did not link to the Teams Link provided to her and so I tried several times to reach her by telephone. Her voice message advised that she was unable to answer the telephone because she was at training for 3 days. I called the number that I was directed to and the person answering that phone stated that she could not help me other than to give me another number to ring. That call also went to voicemail.
- I spoke to Ms Lammas who is no longer a respondent in this matter. She advised that Mr Slater had not received a notice of hearing for today.
- In any event I am dismissing the claim because the applicant did not attend the hearing or request an adjournment or notify the Tribunal that the matter has settled. See sections 78(1)(i) and 92(1) Residential Tenancies Act 1986.
- Further to this I am not allowing the applicant’s application for name suppression. I can do so on a party’s application only if they are wholly or substantially successful with their claim. C ter Haar 26 June 2025
