Order
- The tenancy of Shaye Kathryn Reid at 24 Edwards Court, Pukekohe, Pukekohe 2120 is terminated, and possession is granted to [The landlord/s], at 11:59pm today, 11 March 2025.
- The Bond Centre is to pay the bond of $2,640.00 ([Bond number suppressed]) to [The landlord/s] immediately.
- Shaye Kathryn Reid must pay [The landlord/s] $3,898.47 immediately, calculated as shown in the table below:
- The Tribunal orders suppression of the landlord’s name and identifying details.
Reasons
- The landlord attended the hearing.
- The tenant did not attend and did not answer the calls made to her phone numbers (two: ending in 272 and 178) during the hearing. She had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
- The landlord applied for termination of the tenancy, rent arrears and refund of the bond. Since the application was filed, the landlord became aware that the tenant may have abandoned the tenancy. She is not engaging with him.
- Rent was at least 21 days in arrears on the date the application was filed and is well in excess of that today given the last payment was made in December 2024. Accordingly, the tenancy is terminated. See section 55(1)(a) RTA.
- The landlord provided rent records which prove the amount owing at the end of the tenancy. The tenant was in credit for her water rates and that amount it applied to this order. The bond is to be transferred to the landlord in part payment of the debt.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee and approve their claim for suppression.
