Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord name and identifying details.
The landlord may dispose of all remaining goods and rubbish left at the premises by the tenant as the landlord sees fit.
Taslim Shah must pay [The landlord/s] $27.00 immediately, for the filing fee.

Reasons

The landlord’s representative attended the hearing by video conference today. I telephoned the tenant but there was no answer. I continued the hearing as he has been sent email and text notifications of the hearing date and time.
The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy.
The landlord allowed 3 weeks for the tenant to collect any goods and the tenant authorised family, who did come and do this.
It is not practicable for the landlord to the return the goods to the tenant. The photographs satisfy me that the value of the remaining goods is below the cost of storing, transporting and selling them. I now authorise the landlord to dispose of all remaining goods and rubbish left at the property. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986.
The RTA allows a landlord to dispose of goods without a Tribunal order if it first gives a tenant a fair opportunity to collect them, and (if they are not collected) then makes reasonable efforts to assess their market value. If the value is less than what it would cost to store, transport or sell the goods, then the landlord may dispose of them as it sees fit; see s62A RTA.
The landlord may make another application to the Tribunal for compensation from the tenant for the costs of disposal.
The claim is successful so I award the filing fee and suppress the landlord’s name, as sought.
