The landlord’s evidence is that on 7 February 2025, a colleague of the property manager checked the premises and found them empty except for rubbish and rotting food.

On 10 February 2025 the landlord received a communication from the tenant confirming that she had vacated the property to protect her from exposure to family violence. That communication has not been provided in evidence.

Based on that confirmation, the landlord re-entered the premises on 11 February 2025 but has not attended to any non-urgent cleanup or remediation work pending confirmation from the Tribunal that the tenancy has ended.

The landlord claims continuing rent until a new tenancy begins. The landlord’s rent records prove that to the end of the current rent week ending 6 March 2025, there is unpaid rent of $3,150.00.

The landlord will be bringing a further claim for cleaning/ repair costs. Decision
