Reasons
- The landlord attended the hearing.
- The tenant did not attend and did not answer the calls made to her phone during the hearing. She had been notified of the hearing by email and text, accordingly pursuant to section 92 of the Residential Tenancies Act 1986 (RTA) the hearing continued in her absence.
- The landlord initially applied for termination of the tenancy on the basis of rent arrears. However, prior to the hearing the tenant vacated. The landlord therefore now claims rent arrears and water rates arrears after the tenancy ended on 24 February 2025.
- The landlord has provided rent records and water rates invoices which prove the amounts owing at the end of the tenancy.
- Because [The applicant/s] has wholly succeeded with the claim I must reimburse the filing fee and approve their application for suppression.
