The tenant attended the hearing, with two support people. The landlord did not.
I am satisfied that the landlord had received proper notice of the hearing time, date and place and chose not to attend. Registry tried to call the landlord several time to confirm whether the landlord was going to attend the hearing. The landlord did not pick up the calls.
The tenant submitted that the landlord had confirmed to him one month after the tenancy ended that she would return his full bond. He confirms that she has not done so and does not respond to his email or phone communications.
There has been no evidence submitted by the landlord that confirms she has any claim over the bond. She did not appear at today’s hearing to defend the tenant’s claim he was entitled to his bond to be refunded in full. Therefore, the Tribunal orders the bond to be returned to the tenant in full. Reimbursement of the filing fee
