- [The tenant/s] tenant/s] must pay [The tenant/s] landlord/s] $2,773.93 immediately, calculated as shown in table below.
Reasons
- The landlord attended the hearing. There was no appearance by the tenant.
- This was a continuation hearing. The tenant did not appear at the first hearing either.
- The landlord has applied for rent arrears, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy.
- This was a fixed-term tenancy that commenced 17 April 2024 for one year. It ended well before the 17 April 2025 end date. The tenant left at short notice.
How much is owed for rent?
- The tenancy ended on 13 January 2025. The landlord provided rent records which prove the amount owing at the end of the tenancy is as claimed and ordered, $2,436.00.
Did the tenant comply with their obligations at the end of the tenancy?
- At the end of the tenancy the tenant must leave the premises reasonably clean and tidy, remove all rubbish, return all keys and security devices, and leave all chattels provided for their benefit. See section 40(1)(e)(ii)-(v) Residential Tenancies Act 1986.
- The landlord claims the tenant did not leave the premises reasonably clean and tidy, and did not remove all rubbish. He also claimed the lawns and gardens required maintenance.
- Invoices for the above tasks were provided. The detail in the invoices was useful as there was no photographic evidence in addition.
- Each invoice line item was worked through. The invoices are accepted as claimed except the line item in the external garden/rubbish invoice for “tidy corner of section by shed, spray weeds and trim the top of the hedge. dump weeds and more old Ply tucked in beside the shed”. This cost for $120.75. I am not satisfied that is tenant liability and that has been removed from the invoice of $731.98, meaning compensation of $611.23 is awarded.
- The tenant did not return the keys. A locksmith invoice for $150.00 was provided. This is awarded.
- The heat pump remote was missing at the end of the tenancy. It was replaced at a cost of $75.00 as invoiced. This is awarded.
- The landlord readvertised the premises and claimed $14.60 for printing costs only. This is more than reasonable and is awarded.
- The amounts ordered are proved. Filing fee
- Because [The tenant/s] landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.
