Both parties attended the hearing.
The applicant has requested the Tribunal to make the following orders. a. The applicant requires an order that she is not liable to the landlord for any amount following the termination of the tenancy. However the Tribunal can only make orders regarding liability to a landlord when a landlord makes an application to the Tribunal and that application has been heard. On 14 March the landlord informed the Tribunal that he wanted to claim compensation from the tenant. The respondent was advised today that the landlord would have to make a Tenancy Tribunal application if the landlord wanted to pursue a compensation claim. Currently there is no application lodged in the Tribunal from the landlord. b. The applicant requires an order that water rates be refunded to her. However the evidence shows that from 2015 to some time in 2024, the cost of water was included in the rent. The tenant was unable to establish when she was required to pay an extra amount and how much extra she paid before the tenancy came to an end. c. The applicant requires an order that she be compensated for the stress created by the respondent’s communication with her that she should pay for damages. It is a fact that claims against people cause stress. However the landlord has a right to communicate with a tenant about damage and the cost of repairs and to express an opinion that a tenant is liable for those losses. The Tribunal cannot make order for compensation where stress arises in the normal course of life.
For the reasons given above the application must be dismissed.
The applicant has applied for name suppression. Name suppression can be granted where a party is substantially successful with a claim. The applicant has not been successful with the application and therefore name suppression is declined.
