Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the Landlord’s name and identifying details.
- The tenancy of Alaifatu Samuelu and Faatoelau Iva at 27 Whai Hua Lane, Mangere Bridge, Auckland 2022 is terminated, and possession is granted to [The landlord/s], at 11.59pm on Tuesday 8 April 2025.
- The Bond Centre is to pay the bond of $2,800.00 ([Bond number suppressed]) to [The landlord/s] immediately.
- Alaifatu Samuelu and Faatoelau Iva must pay [The landlord/s] $4,069.17 immediately, calculated as shown in the table below:
Reasons
- This application was scheduled to be heard by video conference. The tenants did not link to the Teams link provided for them and so I rang three phone numbers provided for them. One phone number did not connect. I left a message on a second number advising that I would ring again in 5 minutes. I rang in 5 minutes and again the phone went to voicemail. Another phone number was answered by a relative who advised me to ring the number I had previously rung twice, again. I did so but it went to voicemail for the third time.
- The hearing proceeded in the tenants’ absence.
- The landlord has applied for termination of the tenancy, rent arrears, water rates, reimbursement of the filing fee and payment of the bond.
- Rent was at least 21 days in arrears on the date the application was filed and so I must terminate the tenancy. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing as at today’s date - $5,700.00. The last rent payment was made on 14 February 2025.
- I also accept the evidence showing that as at 11 March 2025, the tenants owe $1,142.17 in outstanding water charges.
- Further to these payments, I am ordering the tenants to reimburse the filing fee to the landlord because the landlord was wholly successful in the claim against them.
- I am also allowing the landlord’s application for suppression of their name because they were wholly successful with their claim. C ter Haar 08 April 2025
