Order
- The tenancy of [The tenant/s] at Unit/Flat 13, 20 Stanmore Road, Phillipstown, Christchurch 8011 is terminated, and possession is granted to Holmwood Property Management Sherborne Limited as agent for Frank Korver, at 11.59pm Saturday 10 May 2025.
- The Bond Centre is to pay the bond of $1,600.00 (6268771-004) to Holmwood Property Management Sherborne Limited as agent for Frank Korver immediately.
- [The tenant/s] must pay Holmwood Property Management Sherborne Limited as agent for Frank Korver $2,352.71 immediately, calculated as shown in the table below:
Reasons
- Only the landlord attended the hearing, represented by Ms Collins.
- The landlord has applied for termination of the tenancy, rent arrears and refund of the bond.
- Rent was at least 21 days in arrears on the date the application was filed. Although the tenant has made some effort to make payments in the interim the arrears has substantially increased since the application was filed. The tenancy is terminated. See section 55(1)(a) Residential Tenancies Act 1986.
- The landlord provided rent records which prove the amount owing at the end of the tenancy, being the amount of $3,800.00.
- Ms Collins said that she had communicated with Mr Mora-Aldwin yesterday and that he had told her that he had moved most of his things out of the property but would not be able to finish moving everything out until this Saturday.
- In the circumstances Ms Collins asked for a possession order to allow Mr Mora- Aldwin until end of day Saturday to move.
- I have therefore allowed two additional days of rent for Friday and Saturday ($125.71).
- Because Holmwood Property Management Sherborne Limited as agent for Frank Korver has wholly succeeded with the claim I must reimburse the filing fee.
- The landlord did not seek an order for name suppression.
