The tenant must carry out the following work to the premises, which must be completed by Friday 3 October 2024. a. The tenant will return the tenancy premises to a reasonably clean and tidy condition and this includes: • Removing any rubbish and furniture from outside the house, • Removing any rubbish from inside the house, • Moving the furniture and belongings stacked along the walls inside the house, • Cleaning the house so it is reasonably clean. • Painting the walls in the two bedrooms.

If the tenant fails to comply with either Order 2 above, then the landlord may undertake the work and charge the tenant the costs of this work up to $2,000. These costs may be treated as rent in arrears and enforced accordingly.

Reasons

Both parties attended the phone hearing.

This is the second hearing in these proceedings. At the first hearing a work order was made by consent and the hearing was adjourned to allow the tenant to comply with the order.

The landlord claims that the tenant has continued to fail to keep the premises reasonably clean and tidy. The landlord wants the problem fixed. Relevant law – Work orders

Under section 40(1)(a)-(e), Residential Tenancies Act 1986(RTA), a tenant has specific obligations in relation to the tenancy premises.

Where the Tribunal finds the tenant has failed to comply with any of these obligations, where appropriate it may make an order for the landlord to carry out the work. 1

If the work order is not being made by consent of both parties, the Tribunal must also make a monetary order as an alternative to compliance with the work order. This provision does not apply to any work order, or part of a work order, in relation to smoke alarms. 2

A work order may also authorise the landlord to undertake the work and charge the tenant the costs of doing the work, if the tenant should fail to comply with the work order and alternative monetary order. A monetary limit must be imposed by the Tribunal on the amount of costs that can be charged. These costs can be treated as rent in arrears and enforced accordingly. 3

Has the tenant failed to comply with their obligations?

Section 40 (1) of the RTA requires tenants to keep tenancy premises reasonably clean and tidy during the tenancy.

The landlord says the tenant has not kept the premises reasonably clean and tidy. On 15 January 2025 the landlord says they served the tenant with a 14 day notice to remedy the breach.

The tenant acknowledged that the premises was not reasonably clean and tidy as at the hearing date of 12 September 2025.

As an alternative money order, I find the appropriate amount to impose is $2,000 and this shall be the maximum fee charged by the landlord if they are required to undertake the work.

This amount reflects the standard and consistent fees the landlord incurs in relation to rubbish removal, cleaning and painting as required in relation to this tenancy. The alternative money order is made by consent. Suppression

On 8 July 2025 the Tribunal made an order suppressing the parties names and identifying details as the order was made by consent. It is appropriate that a further suppression order is made in relation to this order as this order is made by consent and to ensure there is no suppression breach of the previous Tribunal order. 4
