Only the landlord attended the hearing. Two witnesses were called by the landlord, being [redacted] and [redacted]. I refer to these witnesses as Witness A and Witness B respectively.

The landlord has applied for termination of the tenancy under s 55(1)(c)(v) on the grounds that on 7 March 2024, the tenant assaulted and threatened to assault “any neighbour of the premises ...”.

I note that, highlighting the gravity of a situation where a landlord is seeking termination on this basis, s 55(3) provides: It shall not be necessary for the landlord to give to the tenant notice of the landlord’s intention to apply under this section for an order terminating the tenancy.

On the 7 th of March, the landlord claims that the tenant assaulted another tenant who resides at [Address suppressed]. I refer to that tenant as Witness C. Witness C’s premises is just across from the tenant’s.

Relevant to the application, the tenant was seen punching Witness C and she fell to the ground. This was corroborated to the Tribunal by Witness A and Witness B, who both gave evidence.

The tenant and Witness C then continued to argue and Witness C managed to get into her premises and lock the door. The tenant was then seen punching the Kitchen window and it broke. Photographs were produced of the window and blood on the exterior walls.

The tenant was heard shouting that she would slit Witness C’s throat and come back with a gun to shoot her. A video was also produced and shouting can be heard, presumably by the tenant.

The police were called but Witness C did not want charges to be pressed because of the possibility of retribution. Analysis

I found the evidence of Witnesses A and B to be convincing and they were clear in their recollections of what took place on the day in question. Witness C was reluctant to give evidence but I had the benefit of a statement from her.

I am satisfied that the evidence establishes the tenant both assaulted and threatened to further assault Witness C, who I find to be a neighbour of the tenant’s premises. This sort of breach was incapable of remedy.

The grounds for termination have been made out and the tenancy must be terminated.

Because [The landlord/s] has wholly succeeded with the claim I must reimburse the filing fee.

I am satisfied also that the landlord having succeed in this claim, there should be suppression of the name of the landlord and any identifying details, including the names of all witnesses.
