Reasons
- The landlord attended the hearing, the tenant did not attend the hearing. The tenant was called on the phone numbers provided, but none of the calls were answered.
- I am satisfied that the tenant was notified of today’s hearing and have proceeded in his absence.
- The landlord sought termination of the tenancy.
- Since the application was filed the tenant did not pay any rent. The tenant left the property on the 25 April and the tenant’s sister has now entered into a new agreement to rent the property with the landlord.
- The tenant’s sister attended the hearing and confirmed that she entered into a new agreement with the landlord.
- I am satisfied that the tenancy terminated on the 25 April 2025. I award rent owed up until that date.
- The landlord asked me to make an award for water rates. The landlord did not formally amend her application before the hearing to include water rates owing. As the tenant did not attend, I am not able to make an award for the water rates as the tenant has not been given notice that that claim would be determined today.
- I record that the landlord says that there is $473.93 owed for water rates. Throughout his tenancy the tenant did not pay regularly for water and had not made any payment for water since October 2024.
- The landlord has provided me with copies of the ledger account for water they appear to have been calculated on consumption only.
- Because [The landlord/s] has substantially succeeded with the claim I have reimbursed the filing fee and granted name suppression as requested.
