Order
- An application for suppression has been made in this case, and the Tribunal orders suppression of the names and identifying details of both parties.
- The Bond Centre is to pay the bond of $4,800.00 ([Bond number suppressed]) to [The landlord/s] immediately.
Reasons
- The landlord and [tenant number one] attended the teleconference hearing. [tenant number two] could not be connected.
- From the outset, it was clarified that the tenancy of [tenant number one] had ended as of 25 February 2025 and he was no longer a tenant to this tenancy.
- [tenant number two] had left around 5 weeks after [tenant number one] left the premises leaving 5 weeks of rent in arrears.
- [tenant number one] had paid 1 weeks’ rent of the 5 weeks’ arrears.
- Both parties had agreed to the remainder of the bond being paid to the landlord to offset the outstanding rent prior to the hearing.
- Accordingly, I order the tenant to pay the landlord $4,800.00 from the bond.
- Ordinarily, the landlord would be entitled to the refund of the filing fee also. However, in this case it was accepted that $4,800.00 would be the final amount for settlement.
