Reasons

[The landlord/s], attended the teleconference hearing. The phone number for the tenant, the last three digits being 924, was called twice without any response. As the tenant was served, the hearing proceeded in his absence.

The landlord has applied for rent arrears, disposal of goods the tenant left at the premises at the end of the tenancy and for refund of the bond.

The landlord said the tenancy ended on 3 March 2025 with an email from the tenant saying he had gone to sea and could no longer live at the property.

How much is owing in rent?

The landlord said they struggled to complete a proper rent summary and instead provided a list of rent payments for rent periods made and not made. As the tenancy was short, less than 2 months, I could make out from the landlord’s rent payments list that there were 4 weeks of rent @ $450.00 per week that were not paid by the tenant, coming to $1,800.00 up to 6 March 2025. The landlord said they were claiming rent to 6 March 2025 as they believed he should have paid to the end of the week. However, I note that the tenant did not provide sufficient notice in leaving the tenancy, so I find the landlord’s claim for rent to 6 March 2025 to be reasonable in the circumstances. Therefore, I find the landlord has shown the tenant owed the landlord $1,800.00 in rent arrears to 6 March 2025. Disposal of goods

The landlord has applied for the disposal of goods the tenant left at the premises at the end of the tenancy, which included, according to the landlord, 3 old couches, a fridge left in the garage which was mouldy and unplugged, an old dirty BBQ with broken wheels and a gas bottle.

The landlord provided a copy of an email sent to the tenant asking what he would like them to do with his items, but there was no response. So, the landlord said they have been unable to contact the tenant.

It is not practicable for the landlord to the return the goods to the tenant. The value of the goods is below the cost of storing, transporting and selling them. Therefore, the landlord may dispose of the goods. See sections 62(3)(b), 62B(2) and (3) Residential Tenancies Act 1986 (“RTA”). Refund of the bond

The landlord asked for refund of the full bond of $900.00. However, after the hearing, the Bond Centre confirmed that the landlord had self-lodged 2 bonds online for 2 separate tenancies in neighbouring properties, and put the wrong tenant’s name against the wrong property on the bond lodgements for each. That included this tenancy. I flagged this with the landlord during the hearing, as the bond details did not appear to match the tenancy address. The landlord will have to contact the Bond Centre directly to correct this bond lodgement issue. Given this situation, I am unable to make an order about the bond and so dismiss the landlord’s refund of the bond claim. Suppression

The landlord requested name suppression. As they have been successful with the claim, they are entitled to name suppression. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) RTA.
