Order

An application for suppression has been made in this case, and the Tribunal orders suppression of the Tenant and Landlord name and identifying details.
By agreement the tenancy of [The tenant/s] at [Tenancy address suppressed] is terminated, and possession is granted to [The landlord/s], at 5pm on Friday 6 June 2025, or earlier with the agreement of the parties.
The landlord will arrange the re-letting of the premises.
[The tenant/s] will allow viewings by prospective tenants subject to receiving 24 hours written notice of the time and day of the viewings from the landlord.
The Bond Centre is to pay $300.00 from the bond (BN-00050590) to the landlord in payment of the advertising fee for reletting of the premises.
The balance of the bond of $2,448.00 (BN-00050590) is to remain at the Bond Centre.

Reasons

All parties attended the hearing.
The tenants sought a reduction in the term of their fixed term tenancy which began on 1/1/2025 and was due to end on 31/12/2025.
In addition, the tenants claimed compensation and exemplary damages for the state of the premises at the beginning of the tenancy, maintenance, breach of quiet enjoyment, and failure to comply with healthy homes standards.
After significant submissions from both parties and a witness, the parties negotiated for a considerable amount of time and reached an agreement which has been recorded in the Order.
Suppression has been granted to both parties pursuant to section 95A(4) because I consider it reasonable to do so as the parties reached an agreed settlement.
