Reasons

The Landlord has applied for termination of the tenancy for unpaid rent. The Landlord attended the hearing. The Tenant did not.

During the hearing, the Landlord’s representative advised that Tribunal that the Landlord sought termination of the tenancy for unpaid rent but was also hoping to work with the Tenant to see whether a mutual solution could be reached with the tenant. The grounds for terminating the tenancy are met

Under section 55(1)(a) of the Residential Tenancies Act (the RTA), the Tribunal shall terminate a tenancy for breach where rent was, at the date on which the application was filed, at least 21 days in arrears.

This application was filed on 19 March 2025, by which time the rent arrears exceeded 21 days. The Landlord’s Rent Ledger shows that the rent was in arrears by 22 days at that time.

The tenant continued to miss rent payments and by mid-April 2025 she owed $3,360 – or seven weeks rent. The Landlord is therefore entitled to an order terminating the tenancy. A conditional termination order is appropriate

Under section 55(1A) of the RTA, instead of making a final termination order, I can make a conditional termination order if I am satisfied that: (a)The tenant will pay any rent in arrears; and (b)It is unlikely that the tenant will commit any further breach of section 55(1)(a) to (c) of the RTA.

The first limb of section 55(1A) has already been met. The Tenant has repaid the rent arrears. The Landlord’s representative advised that the Tenant recently paid the outstanding rent of $3,360.

By a very slim margin, I am also satisfied that the Tenant will continue to make rent payments until the end of the current fixed term tenancy, which expires in about two months. The Tenant has made the most recent rent payment when it fell due, and her recent repayment of the large rent arrears indicates an intention to keep the tenancy alive. The Landlord’s representative also indicated a desire to work closely with the Tenant to ensure ongoing compliance with her obligations under the Act.

As I have said, this is a finely balanced call, but given the recent rent payments, the short remaining length of the fixed term tenancy and the Landlord representative’s willingness to continue to work with the Tenant, I consider it appropriate to make the termination order conditional upon the Tenant continuing to make rent payments as they fall due. This means that the tenancy will not terminate if the Tenant continues to pay the rent on time. If she does not pay the rent, the Landlord can enforce these orders.

These orders will lapse upon the expiry of the current fixed term tenancy. If the tenant breaches the order, the possession order is enforceable for 90 days from the first breach. See section 64(4)(b) Residential Tenancies Act 1986. Filing fee and suppression

Because it has been largely successful in its claim, the Landlord is entitled to recover the filing fee of $27. I also order suppression of the names and identifying details of both parties under s 95A(1) of the RTA, on the grounds that both parties have had a degree of success, in that the Landlord has obtained conditional termination orders and the Tenant has succeeded in keeping the tenancy alive.
