Order

- Both parties attended the hearing by video and telephone.
- The Tenant has applied for refund of the bond and compensation for fixed water charges.
How much is owed for water rates?
- The tenancy ended on 3 March 2025. The Tenant claimed compensation for fixed water charges which they had paid the Owner along with the balance of the water rates.
- The Property Manager who attended the hearing was not aware of this as they had never charged the Tenant for water. They also agreed that the Tenant should not be liable for these charges because the rent included water bills. The Tenant provided an email from Watercare, confirming the amount charged for fixed water charges was $310.00 for the period of July 2024 to June 2025. The Tenant sought a reduced amount of $203.00 because they took the television unit.
- In considering the evidence, I find the Landlord is liable to compensate the Tenant $203.00 for the water rates fixed charges.
- The amount ordered is proved.
- The tenant has applied for refund of the bond. The landlord has a claim against the bond, but has not filed a counterclaim with Tenancy Services.
- Section 22B(2) Residential Tenancies Act 1986 provides that, where a tenant applies for refund of the bond, and the landlord seeks payment from the bond, the landlord must file an application setting out the details of the counterclaim. Because the landlord has not filed a counterclaim the bond is refunded in full to the tenant.
- As the Tenant has been wholly successful in their claim, name suppression is granted to the Tenants.
