[The tenant/s], both tenants of a fixed term tenancy agreement, separated last year. The parties agree that [Tenant 2] moved out of the tenancy premises in March 2024. She has not signed the variation removing her as a tenant. She cannot be contacted and she will not engage with the remaining tenant or the landlord.
[Tenant 1] and landlord have agreed the tenancy can end pursuant to section 50(1)(d) of the Residential Tenancies Act 1986 (RTA), which is where the tenant surrenders the tenancy, or delivers up vacant possession of the premises, to the landlord with the landlord’s written consent. The house has to be advertised and a new tenant found. This process has stalled because the landlord wants both tenants to sign the break lease agreement.
It seems most likely to me that [Tenant 2] no longer wants to be a tenant. This is because she has not lived at the house for a year.
Section 77(2)(b) RTA allows me to determine whether there is a tenancy agreement to which this Act applies and to determine the parties to any such agreement. Section 85 RTA allows me to consider the substantial merits and justice of the case.
I find that [Tenant 1] is now the sole tenant. This will mean very little practical change because he has been solely responsible for the tenancy and the rent since the separation, but it will allow him to take control of the break lease process.
I note my advice to the landlord about section 44A RTA.
I am using my discretion to allow suppression for the tenants. This is because there has been no breach of the RTA and therefore no public interest in names. The landlord has not made an application for suppression. See section 95A RTA.
