I am satisfied that the two requirements for the expedited process are met: a. The tenant does not want to contest the abandonment application. b. The information provided by the landlord with the application is sufficient to enable the Tribunal to determine it properly without a hearing (either on the basis of that information alone or with only minor clarifications).

Should the tenancy be terminated?

The Tribunal may terminate the tenancy where the premises have been abandoned and rent is in arrears at the hearing date. See section 61 Residential Tenancies Act 1986 (“RTA”). A tenancy is abandoned where the tenant leaves the premises without reasonable excuse, not intending to return or to meet their obligations, and fails to notify the landlord.

On 20 March 2025 the landlord became aware (or ought to have been aware) that the tenant had abandoned the premises. The landlord said they received a call from the police on 20 March 2025 indicating that the police had discovered a cannabis cultivation operation at the tenancy property. The neighbours told the landlord they last saw the tenants around 18 March 2025. The police have been investigating the cultivation operation and the landlord said the tenants fled. The landlord has not had any response to multiple texts and calls to the tenant, and provided copies of these texts. The landlord provided photographs that showed drug cultivation equipment all through the property, including multiple growing lampshades, plastic sheeting, many stools and plants, a number of power cords, and photographs of the tenant’s few belongings strewn thoughout the bedroom and of a large mess in the kitchen. I am persuaded by this evidence that the tenancy has been abandoned.

The tenant has not contested the application.

The landlord provided rent records which show there were rent arrears at the date of filing the application.

All the requirements for an expedited abandonment application have been met. Because the premises have been abandoned, and rent is in arrears, I am terminating the tenancy immediately. Suppression

The landlord requested name suppression and is entitled to it as they have been successful with the claim. Therefore, I order that the landlord’s name and identifying details and the tenancy address are not to be published. See section 95A(1) RTA.
