Reasons

The landlord attended the hearing today by telephone (with the Tribunal’s permission). The tenants did not attend the hearing which was scheduled to be heard in person. Nor did they request attendance by telephone.

The landlord has applied for rent arrears and outgoings, compensation, refund of the bond, and reimbursement of the filing fee following the end of the tenancy. Rent and Bond

The parties agreed, pursuant to a mediated order dated 4 February 2025, that the tenancy would end on 2 March 2025. The mediated order required the tenants to pay rent to the end of the tenancy in the sum of $11,322.08. Weekly payments of $30.00 towards this debt are being made pursuant to an attachment order.

The landlord has also received a payment of $4,831.89 under the Tenancy Costs Cover provided by WINZ. Taking account of a payment of $30.00 received today, the balance owing by the tenants is $6,493.62. Because the landlord already has an enforceable order for the rent, it is unnecessary to make a further order for payment. I have made a declaration as to the amount owed (not including enforcement costs).

The landlord requested reimbursement of the bond to meet the debt. The bond is security for the tenants’ obligations. The landlord is entitled to apply the bond towards the tenants’ outstanding obligations. I refund the bond to the landlord. Adjournment

The landlord also claims vacated costs, including damage, rubbish removal, and loss of rent. The landlord is waiting on the outcome of their insurance claim. This will determine how the insurance excess is applied and therefore the amounts that are claimed.

I do not consider that the damage claim can be determined until the landlord knows whether they are claiming the full cost of repair, or only the uninsured loss. I have adjourned the compensation claim as requested.

It would assist the Tribunal if the landlord could file a summary of the compensation claims before the next hearing, so that both the Tribunal and the tenants know exactly what is being claimed and the amounts. Any insurance assessor’s reports and photographs are also requested.
